What is business mediation?
When operating a business, there are many different types of dispute which can arise. In the ordinary course of business, there is scope for disagreement and tension with:
- other companies or individuals with whom you are involved in a business deal
- customers who take issue with your product or service
- disgruntled employees or departments.
Often, with each side representing their own interests and refusing to budge, it is incredibly difficult to reach a compromise which is satisfactory to both parties. It can come to seem like you have reached an intractable stalemate whereby neither side can gain any ground.
This is where business mediation can be useful. Business mediation is a process wherein a third party expert in dispute resolution attempts to bring an end to the problem by negotiating an agreement wherein everyone’s concerns are addressed. The idea is that a middle ground is easier to find when you have an unbiased mediator who can suggest solutions and table proposals without being mired in the politics or motives that ordinarily make such discussion impossible.
Advantages of business mediation
One of the reasons that business mediation can be so successful is that the mediator is able to meet with each party separately and to discover the essence of their disagreement. It allows their concerns to be heard without anyone attempting to shout them down or score points, since in the initial consultations they are able to set out their problems without the other party present.
Armed with this knowledge, the mediator is able to disassociate the problem from the underlying aggression or frustration of each party, finding solutions that previously would not have been considered and giving equal weight to the views of both sides. One of the most positive aspects of business mediation is that both sides have the opportunity to get their cases heard.
Of course, business mediation is only worthwhile if you can rely on the arbitrator to be diplomatic, understanding and helpful, otherwise their intervention may only serve to exacerbate the hostility at the heart of the matter. It is important to find the appropriate business mediation firm.
