Employees overseas and employment law

In most instances, an employer in the UK intending to employ overseas nationals in another country initiates, or already manages, a locally incorporated subsidiary which will act as the employer. The UK-based parent company will not in most cases have any contractual relationship with the foreign workers, neither will they be legally obliged to hold liability.

Foreign states are unaffected by the jurisdiction of the UK courts; this includes employment matters of UK citizens and cases brought forward through employment, with exception to the State Immunity Act 1978, the Diplomatic Privileges Act 1964 or the Consular Relations Act 1968. See State Immunity Act 1978 ss.1(1) & 16.
