Will it be a No Win No Fee service and what are the terms?

'No Win No Fee' solicitors work exactly in the way you would expect from the name - at least, they do when they are trustworthy. Our Find a Solicitor service can get you in touch with a reputable and trustworthy solicitor in your area.

The Use of No Win No Fee

No win no fee is the more common name given to the Conditional Fee scheme which operates in England and Wales. When you instruct a law firm or solicitor on a no win no fee basis, you do so on the understanding that you will not need to pay for their services unless they help you to win your case.

If they do win your case, the solicitor will be due a percentage of the amount that you are awarded in compensation. Sometimes, the solicitor will claim his or her fees from the organisation or individual that you brought your legal action against.

While employing a No Win No Fee solicitor can be a great solution if you have a claim to make and not a great deal of money to spare, no legal claim is ever truly free - you will still be responsible for paying any court fees associated with bringing your case. If your case is unsuccessful, the opposing side may claim their own legal fees from you, resulting in further financial losses.

No Win No Fee Solicitors

Many of the solicitors who are part of our Find a Solicitor service will offer a No Win No Fee facility on some types of case. No Win No Fee services are common mostly in cases such as:

  • personal injury
  • reclaiming bank and credit card charges
  • reclaiming payment protection insurance and other mis sold policies

Few other cases are predictable enough to warrant that kind of consumer promise before a case is underway.

It is important to remember that a No Win No Fee solicitor may cost you more than a solicitor instructed, with some fees paid regardless of the outcome; this is because despite the high success rates of such claims, the company value of a win is brought down by the final fee payable if you win.

In short if you do not win you will indeed pay no fee, but if you do win your fee will be potentially larger to compensate for the lower risk element of your case, with fees often around 25-30% as standard.

Many claimants are not in a position to pay any fees, and so a No Win No Fee service – even if it is larger than a standard set rate – is better than no service at all, or indeed taking the matter into their own hands and not receiving the appropriate legal advice and support that would be available to them otherwise.

If the case is not suitable, they will tell you the fees involved for taking the case. It is very important to have an open discussion about fees before you sign up with any solicitor.
