COP1 Court of Protection Application Form
The Court of Protection exists to protect the interests of people who lack mental capacity to manage their own affairs or to make decisions for themselves as a result of some illness or injury – these people are called protected persons.
Sometimes a protected person appoints someone to act on their behalf whilst they still have mental capacity, either with an Enduring Power of Attorney or a Lasting Power of Attorney, and this appointment continues after the protected person looses their capacity. However, in cases where this has not happened, a protected person cannot appoint someone to act on their behalf, and in these cases a concerned friend or relative (or sometimes a social services department) can apply to the Court of Protection to be appointed as the protected persons Deputy, allowing them to make decisions on behalf of that person.
This form can be used to ask the Court of Protection to appoint you as a Deputy for someone else, or to make a request for the Court of Protection to give a ruling in relation to the validity of an Enduring or Lasting Power of Attorney.
