COP25 Affidavit

An affidavit is a written document in which the maker sets out a statement of facts. When the statement is complete, the person making the affidavit takes it to a Solicitor, Barrister of Commissioner for Oaths and swears an oath that the contents of the document are true. The document is then signed and sealed.

Anyone who knowingly makes a false statement in an affidavit is guilty of perjury or contempt of court, and could be fined or imprisoned.

Sometimes, in particularly formal or solemn matters, the Court will not accept evidence in the form of witness statements and will require an affidavit. This form can be used as a template for making a affidavit for use in the Court of Protection.
