COP8 Application relating to the registration of an Enduring Power of Attorney

An Enduring Power of Attorney (EPA) is a document under which one person (the donor) can appoint others (called attorneys) to deal with his affairs and make decisions if he becomes mentally incapable. The attorneys cannot act under an EPA until it has been registered with the Office of the Public Guardian.

If someone objects to an EPA being registered, they can use this form to ask the Court of Protection to block the registration. This process might be used where a donor still has mental capacity and wants to prevent his attorneys from acting on his behalf, or where a relative of the donor is concerned that the EPA is not valid because the donor was pressured into signing it, or because it was made after the donor became mentally incapable.

 

This form can also be used to make other applications in relation to an Enduring Power of Attorney. Please note, a different form (COP7) Should be used for applications to block the registration of the newer Lasting Power of Attorney.
