EAT3 Respondent's Answer to Notice of Appeal

Either party to an Employment Tribunal claim can appeal against a ruling or judgement of the Tribunal. The party making the appeal is called the Appellant, and the other party is referred to as the Respondent. Depending on who won the case the Respondent at appeal may not be the same party as the Respondent at the first hearing.

Appeals are heard by the Employment Appeals Tribunal, and once the Appellant has lodged the Appeal, the Appeals Tribunal will make a preliminary decision as to whether the appeal will be heard and will then notify the Respondent.

The Respondent must complete this Answer to the appeal, confirming his contact details, that he intends to resist the appeal, and any grounds on which he intends to resist (in addition to the grounds already found in the Tribunals initial judgment). Where the Respondent sets out additional grounds on which the appeal should be denied and the original judgment of the Tribunal upheld this is known as a “cross appeal”.
