LPA005 Disclaimer by a Proposed or Acting Attorney

Using a Lasting Power of Attorney, anyone can appoint people to act on his behalf if he becomes incapable of making his own decisions as a result of injury or illness. The person making the Lasting Power of Attorney is called the donor and the people appointed to act on his behalf are called attorneys. Attorneys have a responsibility to manage the donor’s affairs in his best interests and they are supervised in this by the Office of the Public Guardian and the Court of Protection.



A person who is appointed as an attorney is under no obligation to act if he doesn’t wish to or is unable to. He can formally retire by disclaiming his appointment as attorney by completing this form and sending it to the Office of the Public Guardian.
