Using a Lasting Power of Attorney (LPA) it is possible to appoint people who will act on your behalf and make decisions for you if you become mentally incapable and cannot manage your own affairs. The person making the LPA is called the donor, and the people who are named on his behalf are referred to as his attorneys.
Before an attorney can act under an LPA, the LPA must be registered with the Office of the Public Guardian. This is to ensure that attorney’s do not take advantage of a vulnerable donor and that they act in his best interests.
The donor, someone named on the LPA or someone representing him can object to the LPA being registered by starting legal proceedings in the Court of Protection. In these circumstances it is important for the person taking legal action to notify the Office of the Public Guardian using this form. If notification is not received, the registration may go ahead.
