N242A Notice of Offer to Settle Part 36
At any point during a court claim, either party can make an offer to the other side to either the whole claim or a part of it out of court. These offers are “without prejudice” which means that the party making the offer does not make any admission that he is at fault and the Court cannot be told about the offer before it has given its judgment.
If an offer is made in accordance with part 36 of the Civil Procedure Rules (the rules of the court) it is called a “Part 36 Offer”. A party which unreasonably rejects a Part 36 offer and then loses the cases can be penalised when the Court decides who should pay the legal costs.
This form can be used as a template for making to make a Part 36 offer by either side.
