N285 General Form of Affidavit
An affidavit is a written document which is sworn (made under oath) in front of a solicitor, an officer of the Court or a commissioner for oaths. Someone who knowingly swears a false affidavit commits an offence of perjury or contempt of court and could be fined or imprisoned.
Usually the Court will accept evidence in the form of a witness statement, but in some very serious or sober proceedings or claims the court will require evidence to be given more formally in an affidavit. For example, this is the case where such as where a party is seeking a search order or an injunction freezing the other party’s assets.
This form can be used as a template for making an affidavit for use in legal proceedings.
