N292 Order on Settlement on behalf of patient or child

In any claim (or potential claim) both the Defendant and the Claimant can make a “without prejudice” offer to settle the claim out of court.

However, where the Claimant is a child or a person who lacks mental capacity to manage their own affairs (called a “protected person”), the settlement is not binding until the Court has reviewed the offer, and considered whether it is fair and is in the child or protected person’s best interests. Usually there is a hearing in which the parties will explain the facts of the claim, the prospects of success and the terms of the settlement to the Court.

If it is satisfied then the Court will issue an order approving the settlement and making it bindning, and this document can be used as a template for that court order.
