N316 Application for order that a debtor attend court for questioning
Where the Claimant obtains a judgment against the Defendant he will often have little or no idea of the Defendant’s finances. Before he makes any decisions about how he will enforce the Judgment he will need to obtain information about the Defendant’s income and outgoings, or any property or assets which could be used to satisfy the judgment debt.
The Claimant can use this form to request that the court orders the Defendant to attend for questioning, and he can then ask the Defendant questions about his finances under oath. If the Defendant refuses to attend, then he will be guilty of contempt of court and may be fined or imprisoned.
This form should only be used where the Defendant is an individual or a Partnership – there is a separate form for use with companies (form N316A).
