N337 Request for attachment of earnings order
In most circumstances where a Claimant wins his case and obtains a judgment, the Defendant will not pay willingly. In these cases, the Claimant will need to take further legal action to enforce the judgment and he has a variety of options open to him.
An Attachment of Earnings Order is a court order which directs the Defendant’s employer (or someone else from whom he receives an income) to deduct the judgment debt from those earnings or income before they are paid to the Defendant, in much the same way as tax and national insurance contributions are deducted. The Court will take into account eh Defendant’s income and outgoings and any priority debts which he has, and will usually order that the judgment debt is deducted by monthly instalments which are affordable to the Defendant.
The Claimant can use this form to ask the Court for an Attachment of Earnings Order.
