N5B Claim Form Possession Claims using the Accelerated Possession Procedure
The Court has adopted as special fast-tracked procedure for dealing with routine possession cases in which a landlord is seeking a court order entitling him to evict a tenant and take possession of the property. This accelerated procedure can only be used in relation to assured shorthold tenancies, but is much simpler and quicker than the standard possession claim procedure.
A Claimant can start a claim under this accelerated procedure using the N5B claim form, which must be submitted to the Court in triplicate. Once the Claimant has paid the court fee and the claim has been issued by the court, he will need to serve a copy of the issued claim form on the Defendant.
Service of the claim form must be done in a way which complies with the requirements of the Civil Procedure Rules, and in some cases the Court may offer to serve the claim on the Defendant on payment of an additional fee.
