Declaration of Trust in Relation to Land (Tenants in Common)
This document is a declaration of trust, which can be used by the owner of real property (land or buildings) to create a trust over that property in favour of himself and one or more other beneficiaries, where the beneficiaries will be ‘tenants in common’. This means that they may hold the beneficial interest in differing shares, and if one joint tenant dies, his interest in the property is inherited according to his will.
The document may be used for example by a group of friends who consent to joint ownership of a property but wish to manage their share independently.
