Possible outcomes of mediation

Disputes in mediation can have a number of different outcomes, all of which must be agreed to by both sides.

These can be:

  • a refund
  • a compensation payment
  • an explanation
  • an apology
  • a replacement of goods and services
  • a change in policy or behavior.

The two parties are completely responsible for what comes out of the mediation. The mediator has no power to decide the type or amount of a settlement.

In the case where your dispute has already been issued at Court, it is required that you tell the judge that an agreement between the two parties has been reached.

If the two sides cannot reach an agreement then you must tell the judge that an agreement between the two parties has not been reached. Mediation is not guaranteed to solve the result, but may still help settle part of it.
