Mediation is now seen as a very effective option for solving a legal dispute, as going to court is almost always costly and stressful. Going to trial can last months and sometimes years, with no certainty that the result will be acceptable to both sides.

Mediation is also called Alternative Dispute Resolution (ADR), and is mainly employed when two contesting sides wish to arrive at a solution but cannot achieve a settlement. The majority of individuals do not wish to go to court and so mediation provides an alternative.
The mediation process
Mediators draw together the different sides and their legal representatives and try to find a practical solution between the two parties by sensible negotiation rather than aggressive legal confrontation. If successful, the advantages of finding an agreement are personal and financial. An agreement also does not set a precedent for similar legal disputes later in time. Mediation is always completely private and so can prevent unpalatable publicity if you’re a company or notable individual. Because of the results of Mediation, more and more cases are now being encouraged by the Courts.
