The back is fundamental to the processes that we go through everyday; something as essential as walking and even moving from a sitting to standing position could be badly affected by back injury. Back classification
The back is the rear of the torso, run through by the spine, and extending from the neck down to the buttocks. However, back injury claims only cover the portion of lower and middle back since the upper part is commonly included with the neck. Spinal and soft tissue injuries are the kinds of damage that you may be able to claim compensation for.
Back injury compensation claims
If you have suffered a back injury that occurred through a lapse on the part of someone else and you wish to pursue a compensation claim, then you should engage a solicitor who can advise and manage your case.
Compensation can be awarded in relation to two matters. The first is called general damages in legal parlance; it has its foundations in the qualified medical evidence that is needed for a compensation claim and concerns the hurt and distress the injury has caused. The second attempts to atone for monetary loss, through refunding medical bills and any income that you have been prevented from earning because of the back injury.
The amount of compensation you might expect to receive depends solely on what kind of injury you have sustained:
- least injurious back damage - £1,000 to £5,000 – for injuries that have lasted more than a few weeks, but have healed thereafter
- minor injury - £5,000 to £8,000 – incapacities lasting 2 to 5 years, strains or such things as a prolapsed disc that didn't need surgery
- serious injury - £8,000 to £25,000 – prolapsed discs that did need surgery to remove some spinal vertebrate, or crush fractures, spinal fusion and premature aging of the spine
- critical back injury - £25,000 to £110,000 – this is the figure for the worst type of back injury. Paralysis, sexual difficulties and organ damage are the most critical injuries.
