Broken Bones Compensation

Claiming for bone fractures

Broken bones, or fractures, can occur all over the body, indeed anywhere that there is a bone. They can occur as a consequence of a disease such as osteoporosis or bone cancer, but more frequently it is a forceful impact or stress that is the progenitor of a bone fracture. If you have broken a bone and it was caused by an accident that was no fault of your own, you may be able to claim compensation from whoever is responsible.

Fracture classification

Whilst all fractures can be classified into one of two groups, open and closed, which refers to the breaking or not of the skin, the types of fractures that are important for compensation claims are as follows:

  • hairline fracture – a crack and not a full break
  • simple fracture – can be either complete, where the fragments separate, or incomplete, where they do not
  • displaced fracture – a complete fracture where the fragments have been knocked out of line
  • compound fracture – where the bone has several fractures that can be of varying types
  • comminuted fracture – the shattering of the bone into several pieces
  • stress fracture – the result of repeated stress on the bone rather than a single impact; can be a variety other types too
  • spiral fracture – where part of the bone has become twisted
  • impacted fracture – different parts of the bone have been driven into each other
  • greenstick and buckle fractures – unique to children, greenstick cracks on one side, buckle does not crack at all. Both only deform because of the flexibility of children’s bones and do not fully break.

Broken bone compensation claims

If you have suffered one of these fractures and someone was responsible, you may be able to claim compensation. Contact a solicitor to aid your legal quest if you want to proceed with your case. The estimates of how much you may receive are too numerous to list here; go to the relevant section on the body part that you have broken a bone in to find out more information.
