Dental Injury Compensation

Claiming for damage to the teeth

A dental injury that was the result of an accident that was not your fault, or negligence on the part of a dentist, could enable you to make a claim for compensation.

Dental classification

Dental injury encompasses damages to your teeth, gums and jaw. This can occur in any number of ways, for instance through a car accident, by falling over and hitting your mouth or because of a dentists poor practise when treating you. Violent assault could also be a cause of dental injury and in this case you do not need to establish that anyone was at fault; the testimony of a conviction secured through witnesses, evidence or confession is more than enough.

If one of the above situations applies to you then you should pursue a claim for financial damages and recompense. Engaging a solicitor (look to your right) to advise on the complications of the legal system is your initial step on the road to getting compensation. The compensation itself will take on a duel aspect of general damages and fiscal loss.

General damages will be dependent on a full professional dental report that can detail the extent of your injury and the recovery that is expected. Your solicitor may be able to make a projection of the amount you should expect before your case comes to fruition. Fiscal loss is based on the possible dental bills you may have accrued because of your injury and the possible detriment it could have had to your employment.

For dental injuries, what follows is a rough outline of the compensation you might expect:

  • back teeth injury - £700 to £1,150
  • front teeth injury - £1,400 to £2,500 – because of possible corruption of aesthetic appearance due to the prominence of front teeth, you should expect a higher payout than for back teeth
  • fractured jaw - £4,000 to £29,000.
