Knee Injury Compensation

Claiming for damage to the knees

The knee is a hinge joint that connects the upper and lower parts of the leg and enables walking. It is the largest joint in the body and is an exceedingly complex piece of natural engineering.

Knee classification

The knee connects the two lower leg bones, the tibia and fibula, with the upper leg bone, the femur. There is also a bone at the knee itself commonly called the knee cap, but which carries the medical name patella. As it is a joint, the knee also contains cartilage, tendons, ligaments, and connects some of the largest muscles in the body. All of these can come to injury and all of these, should they have been injured by a third party’s actions, could be claimed for. Injuries sustained by the knee include anterior cruciate ligament damage, fractures, ruptured tendons, knee-capping and torn meniscus (commonly referred to as torn cartilage).

Knee injury compensation claims

If you have suffered a knee injury because of someone else's misdemeanour and you wish to claim for compensation, then it is advisable to contact a solicitor. A solicitor will help you determine whether there is any likelihood of winning the case and therefore proceeding in the claim. Should this be in the affirmative then they will be able to organise and pursue your claim for you.

Compensation parts in twain when the determination of actual compensation awarded is looked to. One part takes a report from a qualified medical professional, and using this arrives at an idea of the pain you have gone through during the injury and any restrictions this imposed on your lifestyle, to give an award of general damages. The other part encompasses your financial losses; both expenditure for the recovery and money that never made it to your bank account because you were prevented from earning it. After these individual analyses are made, the parted twain are allowed to converge and a whole figure can be applied to the compensation you receive.

Examples of compensation based on the type of injury you suffer are:

  • bruising and twisted knee - £1000 to £3800 – recovery within a year, no further complications
  • badly twisted knee - £3800 to £9000 – continuation of pain and inconvenience
  • torn cartilage or meniscus - £9000 to £17000 – or knee dislocation, that results in need for a knee brace
  • severe knee injury - £17000 to £62000 – patella fracture, damage to ligaments, torn cartilage that leads to complications such as limitation of movement, osteoarthritis, knee replacement surgery or other debilitating symptoms.
