Claiming when you weren't at the wheel

If you are injured as a passenger in a car or on a motorbike, then you are entitled to make a claim and should do so, no matter who the driver of the vehicle was.

The fact that you may know or be related to the driver is of no consequence. It may make you feel embarrassed about bringing a claim, but it shouldn't. Bear in mind that if the driver was not at fault, then your claim will be against the other party responsible. Even if your driver was partly or wholly at fault then your claim will be handled his or her insurance company, so he or she will not be paying you anything themselves.

Remember the driver of your vehicle owes you a duty of care to ensure that you are reasonably safe and the same principle applies to other drivers and road users. If this duty is breached and you are injured then you are entitled to seek compensation.
