Personal Injury Claims
What is a personal injury claim?
We’ve all seen the adverts on television promoting personal injury claims lawyers for those who have suffered in accidents which were not their fault, but many people are not certain exactly what the law says on this issue. Is it true that if another individual causes an incident in which you suffer harm then you are able to take legal action against them to claim compensation?
The answer is yes. Under UK law, if somebody’s negligence causes another individual harm, then the party who has suffered injury is entitled to bring personal injury claims against them in order to receive compensation for the harm and loss incurred. This is an essential part of the law and is considered very important in ensuring that people are not able to get away with being careless and failing to take into account injuries that they may cause to others.
Personal injury claims have several different aspects to them which will need to be proven if the case is to be successful. It has to be demonstrated that the injury suffered was a result of the defendant’s negligence, and that they could have anticipated that harm might result and taken action to prevent this but failed to do so. There must also be evidence of loss on the part of the victim, whether this be in the form of an injury which was sustained, a loss of income as a result of the accident or any other suffering or material deficiency.
The idea of personal injury claims is not to punish the defendant but to restore the victim to the financial position they would have been in had the accident not occurred. This can be hard to estimate in the case of injuries, but a professional injury solicitor will be able to assist.
