Forklift Accident Claims

Compensation for injuries sustained while operating a forklift truck

Compensation claims can be made for injury caused by defective maintenance or operation of a forklift truck. There are numerous types of forklift truck used so it is important to know whether the type of truck you use can claim compensation for an accident which was due to a defect.

A common truck used is the pallet truck. The pallets are wooden structures to help transport heavy items. Counterbalance trucks are vital for transporting heavy objects as the truck will lift from the front. Therefore a substantial counterbalance is needed to ensure it doesn’t topple over. Side loader, telescopic and bin tipping trucks are also widely used in the workplace. These consist of many attachments on the truck which depend on what is being transported. Another type is a high low loader, which is simply used to raise and lower heavy objects.

The injuries you can suffer as a result of forklift accidents also vary. Types of injuries include:

  • Crushing injuries – due to the carelessness of the driver trucks can easily end up crushing parts of your body. If trucks have had a mishap due to a defect or not being properly maintained, it will strengthen your claim for compensation.
  • Back injuries – neck, back and spine injuries are very common when the truck you are operating does not have any suspension or if you have been working on an uneven surface. If your employer did not attempt to help the conditions you should claim for compensation.
  • Inadequate training – if you have any injuries or accidents due to not being fully trained, your employer will be responsible. Full training is usually represented by a valid licence.
  • Fatal injuries – in the awful and rare case of a death you family can claim compensation. A death is usually a result of impact to the head.
