Probate Help
Law on the Web is proud to have partnered with specialists in Probate and Estate Administration. They contribute much of the free advice available in our Probate section, and offer professional Probate services to anyone who needs them. Here's some information about the help they can provide:
How can solicitors help?
Whether the administration is completely straightforward or very complex, they take on all the personal representative’s tasks and liabilities, leaving you free to handle other matters. Where the deceased owned assets overseas (perhaps shares, or a second home) they can deal with them, quickly and cost effectively. Should any of the beneficiaries be hard to find, they can sometimes be located using a tracing service.
What solicitors can offer
-
A Free Probate Helpline: You can call them for free advice and answers to any questions you may have about Probate, bereavement or simply what to do next
-
A Free, no obligation home visit: If you or your family need help with Probate, they can help you on the telephone, or they will visit you, at a time and place convenient to you, to assess the estate and quote a fixed fee to carry out the work.
-
An All-inclusive fixed fee service, quoted in advance. A fixed-fee means that you know in advance exactly what the total cost will be without the worry of a ‘ticking meter’ every time you contact us.
-
A dedicated Case Manager who you can call at any time and who will work to ensure that Probate is obtained quickly and efficiently.
-
An in-house team of qualified accountants, legal professionals and tax experts to ensure that the case is completed correctly and without delay.
Who pays?
The estate pays the fee, but not until the grant arrives and there are sufficient liquid funds in the estate to do so.
Planning ahead
Many people, when writing their Will, are unsure who to appoint as executor. It’s quite normal to appoint a professional executor either solely or alongside family members or others.
Some companies make no charge for being named as executor and will step aside at no charge if your circumstances change or if your family requests us to before the application for the grant.
For your protection
Insurance
Probate services should have Professional Indemnity Insurance. The policy covers the Company against any claims for professional negligence, fraud or dishonesty.
Client Monies
Funds are held on behalf Clients in separate Bank Accounts. These Bank Accounts are held on trust and are designated Client Accounts. Although the bank accounts are in the name of the company, they do not form part of the assets of the company and are held in separate segregated accounts for the specified client. They are not available to the Creditors in the event of solvency of the company nor can they be offset by the company's bankers against other bank accounts.

How a person's estate is composed
While most people would be uncomfortable summing a person as just the net worth of all the things they own at any one point in time, they would probably concede that this is the best way to go about the process of probate. In legal jargon a person’s estate is the net worth of all their possessions at any one point in time.
