Letter of Claim for Generic Misrepresentation Claim

When deciding whether you wish to pay someone else to supply you with goods or services, one of the primary means of judging the value of this contract is by the information they provide. If it therefore turns out that you were misled about what was on offer, whether it’s a product that doesn’t do what was promised or a service that isn’t up to scratch, then the other party is guilty of misrepresentation and you may be able to claim compensation.

Misrepresentation is where you are induced or persuaded to enter into a contract because of a false statement of fact which the other party to the contract makes, whether deliberately or mistakenly. If it can be shown that but for the false statement, you would never have entered the contract, you are entitled to compensation or to have the contract set aside. You may also be able to claim for any losses you have incurred as a result of taking out the contract.

This template letter can be used to demand compensation or remedial action from a party to a contract who has made a misrepresentation. It’s legally approved and simple to use – all you have to do is fill out your details where prompted.
