N11D Defence Form Demotion of Tenancy

The Antisocial Behaviour Act 2003 gives the court to remove security of tenure and protection from eviction from tenants who are using their social housing for illegal or immoral purposes or whose antisocial behaviour is causing problems for their neighbours.

If a social landlord makes a claim in which he asks the court to exercise this power, the Defendant can dispute the case put forward by the landlord be filing a defence to the claim. If the Defendant simply ignores the claim, the landlord may be entitled to judgment in default.

The Defendant can file a defence within 14 days of service of the claim using this form (although the deadline for filing a defence increases to 28 days where he has already filed an acknowledgment of service.)
