N380 Application for a Charging Order on Securities

Once a Claimant has won his claim and has been granted judgment he will often need further assistance from the court to ensure that he gets paid. Sometimes Defendant’s are not able to make a cash payment immediately or refuse to pay the judgment debt outright.

A Charging Order can be used to impose a legal charge over property owned by the Defendant. This charge remains in force until the judgment debt is paid, and whilst it is in force the Defendant cannot sell or transfer the property.

This form is specifically designed for use by a Claimant who wants to apply to the Court for a charging order over securities which are owned by the defendant. This can include bonds, debentures, promissory notes and shares and stock options.
