Q: I received a letter about a disciplinary meeting next week after an investigation took place concerning my timekeeping abilities. I was unaware that this investigation had taken place as I hadn’t been told. I have been an employee here for 7 years. I had an initial meeting with my manager about timekeeping which I took on board. My manager had informed me that it could possibly lead to an investigation. I have now been invited to a disciplinary hearing next week. I have been informed that the woman who carried out the investigation will be chairing the disciplinary hearing. I have been told that the sanction may be a final written warning. What should I do about this situation?
A: Your employers should have informed you of the investigation that was taking place according to company policy. An informal meeting should have been set up in accordance with the regulations of ACAS and someone different should be chairing the disciplinary hearing. You should dispute these matters immediately informing your manager of the correct procedure to follow. It is unsure what sanction you will be receiving but it is likely to be a final written warning.
I am facing a potential redundancy situation but I would like to claim against my employer for breaching the terms of contract. I have worked there for 23 years and the contract includes 12 months notice and a bonus when faced with redundancy, yet my employer is trying to renegotiate the contract by reducing the salary, not giving notice and not paying the bonus. I was invited to a meeting yesterday afternoon and handed the notification of potential redundancy. The process is to be completed on Friday and at least four members of staff are to be affected. The meeting yesterday suggested that the salary would be reduced to a third. I have asked for further details about this before another meeting takes place. I believe that if I do not accept the reduction in salary then I will not get my notice period or bonus. This is not a discretionary right and the bonus is a substantial amount. What should I do about this situation?
