Q: I recently sold a horse to someone but they claim that the horse is defective and isn’t capable of the workload he was expecting. I gave him several opportunities to inspect the horse but he declined to view it and I never misrepresented the horse’s capabilities. Do I have liability towards him?
A: If the buyer was given a reasonable amount of opportunity to inspect the product, then caveat emptor (buyer beware) applies. If there was no negligent or fraudulent misrepresentation of the product, then you have no liability towards the consumer as they failed to take care when buying the product.
My stepdad has taken my car to a local garage and he has been advised by them that my car is rubbish. My stepdad then sent a letter to the company from which I purchased the car, informing them that we are rejecting the car, but they have not responded. What can I do next?
read moreI recently purchased a new car and the insurer told me that I would be the first owner. I received the car but the car documents show that I am the second registered keeper of the car. I feel I have been mis-sold the car and that the seller has committed a breach of contract, as it is clearly not the case that I am the first keeper of the car. I specifically wanted a new car and have a video recording of the verbal contract stating the seller said this.
read moreI recently purchased a car from a used car dealership. I have a 3 month warranty with the purchase. The car seemed fine when it was purchased but on the way home the power steering on the car went. I called the dealership when I got home and was told to bring it back. I took it back 4 days later after discovering 2 oil leaks and that the heater didn’t work properly. I wished to return the car but the garage wanted to repair it and refused to take it back. The seller said that after 4 days of purchase I cannot reject the car and have a refund because “he doesn’t do that”. I then stated it was my legal right as the vehicle was faulty and the seller just laughed and would not refund the money. Since then I have had minimal use of the car to keep the mileage down and to increase chances of rejection. I have been carrying out ongoing calls to take further action. What else must I do?
