Q: I recently purchased a car from a used car dealership. I have a 3 month warranty with the purchase. The car seemed fine when it was purchased but on the way home the power steering on the car went. I called the dealership when I got home and was told to bring it back. I took it back 4 days later after discovering 2 oil leaks and that the heater didn’t work properly. I wished to return the car but the garage wanted to repair it and refused to take it back. The seller said that after 4 days of purchase I cannot reject the car and have a refund because “he doesn’t do that”. I then stated it was my legal right as the vehicle was faulty and the seller just laughed and would not refund the money. Since then I have had minimal use of the car to keep the mileage down and to increase chances of rejection. I have been carrying out ongoing calls to take further action. What else must I do?
A: You must draft a letter before action stating the terms of the Sale of Goods Act. You potentially have three options to take. As rejection may be unlikely as it has been in your possession for a while, taking this issue to a small claims court will help support your case. In addition to the minimal use of the vehicle, the ongoing phone calls and the statement that “he doesn’t do that” will all help to support your claim. Include in your letter that that the car dealer will be liable for any costs of repair.
I bought a device that had a rechargeable battery. I plugged it in to charge overnight and it exploded and damaged our walls. I spoke to the company that sold the device and they claimed that it was not the first time this had happened. The third party appears to be admitting responsibility. Can you advise me on this?
