Q: A fence from a third party has blown into my garage causing damage; the weather was particularly strong that day so I don’t know if it was negligence or not. The fence was already in disrepair though. What should I do?
A: The test for negligence is whether the damage was a reasonable consequence of the bad state fence. This is difficult to prove if the winds were unusually strong. It is recommended that you contact the MET office and see if the strength of the winds were expected for the time of year.
