Q: My neighbour is the tenant of a building and his flat has flooded causing property damage to my flat. Who is liable; the tenant or the landlord?
A: Usually, the starting point would be to hold tenant liable for the damage. The tenancy agreement however may say that the landlord will be held responsible so it is always worthwhile to check the agreement before starting legal proceedings.
