Q: My next door neighbour’s tree reaches over onto my property onto my garage. A branch fell off the tree and hit the garage causing damage. This was paid for by insurance. I am now concerned that my neighbour's tree will cause further damage as the branches are large and unwieldy. What can be done?
A: You should write a letter discussing the nuisance and damage caused, and the foreseeable future of your neighbour’s tree. You could request your neighbour to trim and manage the tree as a result of your concerns if they are willing. Also notify them that if further damage is caused by the tree, you will look to hold your next door neighbour liable and recover the cost of any damage from them.
