Q: I received a letter on behalf of a third party solicitor on the grounds of a possible liability claim. I was walking with my dog and baby grandson in a pram. My dog came off his collar and went into the road, causing a collision. Insurance want an outlay of £995 recovered but I have already been told that the third party will be covered. What should I do?
A: The third party may be successful in a claim for negligence, though you could potentially argue that it was not foreseeable that the dog would come off the lead and that you were therefore not negligent. Although costly, it would be wise to seek assistance from a private solicitor. Send a holding letter to the third party’s solicitor stating that you are taking legal advice and will be in contact shortly.
I was stopped by the police and found to be driving over the limit. I have been given a date to appear in court. I have been advised to plead guilty but to also say this was a one-off incident in which I drank alcohol as pain relief, proving to the court that this type of offence will not happen again in the future as they have a duty to public safety. Do you suggest I should say this?
