Q: I have been charged with a speeding ticket by the council and the photo they used as evidence is unclear and I have no idea if I was speeding or not or that I was even driving at the time. Will they be able to prosecute me?
A: The council will only be able to prosecute you if they are able to prove beyond reasonable doubt that your car was speeding at the time they claim. You may wish to defend against the claim, in which case you would need to go to the magistrates' court. Be warned, however, that you may also be charged with not identifying the driver, in which case you will need to show that you have done due diligence to ascertain who was driving.
My wife has not yet changed her name on her driving licence. We got married 4 years ago. Does this pose any legal issues for insurance?
