Q: My employee sprained her ankle a few days ago stepping down from a coach. She went to A & E and stated that she would be off work for 5 weeks. There were no witnesses at the incident and she made a comment that it wasn’t her fault as the coach was not parked in its normal spot. My employee wanted to come back to work today, but I asked her to go to the doctors, who signed her off for 1 week. I have reported this incident to the liability insurer as I am concerned that she will be making a claim.
A: Your employee could wish to potentially make a personal injury claim but there are certain limitations to this. Not much can be done about her injury as it is up to her to decide if she wishes to make a claim or not. You just need to make sure you have followed all the reporting procedures correctly.
I am investigating two of my employees for thefts at the company. I have invited both of them to an informal hearing at the same time to discuss their versions of the events. Am I allowed to do this?
read moreAn employee was injured at work last week. I do not usually pay sick pay but I am willing to pay it this time. She said she was assaulted whilst she was off, I am not sure how to differentiate this injury from that which she sustained at work. She was hurt and sent to hospital but she was not given a note from the hospital, although she is still within the self-certification period. I am unsure of how long she will be off, and I’m considering paying normal contractual sick pay. Would this be accepted as liability? How would I be able to differentiate between the two periods of sickness?
read moreI took on an employee for a 3 month probationary period. I was not happy about the quality of my employee’s work after 3 months. I wanted to terminate the contract but I agreed to train my employee on the condition that they agreed to a pay cut of minimum wage on a trainee basis. The employee has since reported me to the minimum wage commission. I did not have anything in writing stating that my employee was a trainee. What can I do about this situation?
