Q: One of my employees is constantly taking sick leave because she has a child who is poorly but not disabled. Do I have the right to refuse her sick leave?
A: I suggest that you sit down with your employee and tell her that she has the right to request emergency time off to a point where it becomes unreasonable. If the employee still has to take sick leave, she should phone the company to request it. An unreasonable amount of sick leave is very subjective however so you must be careful.
I am looking to temporarily lay off members of staff which may turn to a permanent situation. I would like to know what I have to do as there is no lay-off clause in the employment contract.
