Q: I want to reduce the amount of holidays my employees get per year. There is nothing in the employee contract that gives a specific amount of holiday pay but employees have always taken a fixed number for many years. Is it legal for me to reduce their holidays without consent?
A: It may be beneficial if you consult with your employees about the change otherwise you may be liable to a claim of constructive or unfair dismissal. It is recommended you consult with your employees about the issue and request that they agree to the changes in writing.
An employee has been employed for ten months; he has spent time off sick with cancer, although his pattern of absence has been intermittent, usually two to three days off here and there. I have not challenged him in any way by asking him for self certificates or evidence of any appointments. Should I take steps to check that he has cancer, and if he does, would I be able to dismiss him using the one year limited employment agreement?
