Q: My employee recently suffered a minor heart attack away from the site. He now would like to return to work but I would like to know what my legal liabilities are?
A: As the employer, you owe a duty of care to anyone who works for you. It would also be wise to check your liability insurance, as, if your employee brought a personal injury claim, it would be your liability insurers that your employee would seek compensation from. I suggest you set up a back to work meeting with your employee. Ensure that he understands that as a sub-contractor he has no obligation to provide information to you but that you would like to know whether he feels able to return to work.
I own a cake shop, and one of my cakes, given to a child, was found to contain a sharp pin inside. I have received emails from the parent, to which I apologised and refunded their money. I am concerned at the email, however, and the bad publicity that may result. How can I respond to this incident?
