Q: My father recently changed his will deliberately leaving me out while giving his inheritance to my children instead. He has now died; is there any way I can claim from the old will he created?
A: It is unlikely that you will be able to claim under an old will as the new will shall take precedence, as long as it is valid. You may be able to challenge a will however as a beneficiary under the Inheritance (Provision for Family and Dependants) Act.
Property was left in my father’s will. I am the executor and my brother currently lives in the property. A trust was set up where my brother can remain in the property for as long as he likes and the sale proceeds are to be distributed to the beneficiaries who are the grandchildren. I am concerned about my brother gaining finance over the property.
