Q: I have trust documents set up to protect my property and assets. The house is in the name of my three children, but I want to take away my daughter’s share and give it to one of my sons instead. Can I legally do that?
A: It may be a possibility but you would need to review the paperwork and see the terms of the trust – you may need to make an application to the court. The best person to talk to is the solicitor that created the trust.
My late father passed away 38 years ago and my mother is illiterate. There was no will. My uncle and his partner were the administrators and I believe they maladministered the estate as they both benefitted from my father’s death. I also believe that their solicitor should not have signed and authorised certain things with regards to the administration of the estate. What action can I take?
