I recently bought a new home. Whilst moving in, my new next-door neighbour informed me of the ongoing dispute they were having with a local hotel regarding the amount of noise they make. The previous owner had been fully aware about the dispute but did not disclose this to me. Yet previously, on the property information form, where asked “Do you know of any disputes or anything which might lead to a dispute about this or any neighbouring property?” the vendor’s reply was no. This has not been the case and I have been experiencing ongoing problems with the hotel. I believe the seller misrepresented this by saying that there were no disputes, and I certainly would have not purchased the property – or would at least have renegotiated the price - if I had been aware of the problem. I have looked at the entertainment licence of the hotel and it states that there must be no outside entertainment and the noise from the inside must be inaudible. There has been no noise thus far but I am concerned that during the summer period there will be problems. What should I do about this issue?
